Terms of Sale

This website www.lebolemaison.it is the property of Spazio Lebole S.r.l., with its registered office in Arezzo (Italy) at via Margaritone no. 27 A/B/C, 52100 Arezzo.
The general terms and conditions of contract govern the relationship between the Customer and Spazio Lebole S.r.l. for the purchase of products made available from time to time for this purpose on the website www.lebolemaison.it. For the purposes of these General Conditions, "Customer" refers solely to the consumer, i.e., a natural person who purchases goods for purposes unrelated to any business or professional activity they may carry out. The purchase of products is regulated by Italian law.

Parties to the contract of sale

The website intended for the sale of items via the Internet is managed by Spazio Lebole S.r.l..
Any complaint or request during the warranty period must be sent to the aforementioned company.

Products

Every Lebole fabric jewel is a unique product; no two are the same. While respecting the same color tones, the fabric of the earring that the Customer receives may not be identical to that shown in the illustrative photographs; the color of the stone, however, remains unchanged. It is also possible to request the availability of fabrics and view their images from time to time by sending an email to contatti@lebolemaison.it. The majority of products offered are available while stocks last. Consequently, Spazio Lebole S.r.l. does not in any case guarantee the availability of products for sale for a predetermined period. All Customer complaints regarding the order and shipment of an unavailable item will be considered unfounded.

Conclusion of the contract of sale

All orders placed through the website www.lebolemaison.it constitute a binding proposal for the conclusion of a contract of sale with Spazio Lebole S.r.l. The contract of sale is binding and effective only at the moment the company sends an order confirmation via the website or via email.
Spazio Lebole S.r.l. reserves the right to refuse or cancel a Customer's order in the event of the Customer's insolvency. The data provided by the Customer when filling out order information is the sole responsibility of the Customer. Spazio Lebole S.r.l. cannot be held responsible for errors made by the customer in entering the recipient's details for their order (shipping or billing address), nor for any shipping delays or inability to deliver the ordered products that these errors might cause.

The Customer has 24 hours to request the cancellation of their order via email to contatti@lebolemaison.it and obtain a full refund, including shipping costs where applicable. After the indicated time has passed, Spazio Lebole S.r.l. cannot guarantee the possibility of cancellation.
If the Customer wishes to cancel an order already received, they must return all items included in the order. To return the items and receive a refund, please follow the instructions indicated in the Return Policy section.

Right of rescission in case of unavailable items

Should the ordered items not be available within 14 days of the order date, Spazio Lebole S.r.l. reserves the right to withdraw from the contract of sale even if the order confirmation has already been sent. In the event of withdrawal from said contract, the company will immediately send a notification and arrange for the refund of sums already paid for the items in question.
PricesThe prices indicated on the website www.lebolemaison.it are in euros (€). Information regarding prices and products available on the website is subject to change without notice. The price applied will be the one indicated on the website at the time of the order date. Product prices may change based on trends, stock, and consumer demand. For this reason, Spazio Lebole S.r.l. cannot refund price differences that items may undergo.

Shipping Costs

Shipping rates for Italy are free for purchases of €45 or more; otherwise, the shipping cost is €10, except for contrary clauses indicated at the time of the order contract. The different shipping options (accompanied by their rates) are presented during the order process and specified at the time of the order summary. Payment for the total price must be made at the time of the order unless otherwise specified during the order process and indicated on the invoice. In the event of shipping outside the Italian territory, shipping costs, customs duties, and formalities are the sole responsibility of the customer, unless otherwise indicated. Shipping costs will be calculated on a case-by-case basis depending on the destination. The Customer is responsible for verifying the possibility of importing the ordered products into the destination country.
Payment MethodsThe price invoiced to the Customer is the amount indicated in the order confirmation. The cost of products can be settled through the following payment methods:

SCALAPAY – If the Customer purchases with Scalapay, they receive their order immediately and pay in 3 installments. The Customer acknowledges that the installments will be assigned to Incremento SPV S.r.l., to related parties, and to their assignees, and that they must authorize such assignment.

In the case of payment by Credit Card, the order will be considered effective only after the bank payment center has authorized the transaction. In case of refusal by the bank payment center, the order will be automatically canceled and the Customer informed via email.
In the case of Bank Transfer, the order will be considered confirmed only after the payment receipt is visible on the Spazio Lebole S.r.l. bank website. Payment for products via bank transfer must be received no later than 3 business days from the date of receipt of the email. After this deadline, the contract may be considered terminated pursuant to and for the purposes of Art. 1456 of the Italian Civil Code.
To facilitate the connection between the payment received via bank transfer and the order placed, the Customer is requested to indicate the order reference number in the reason for the bank transfer.

Delivery times and conditions

After order confirmation and subject to the completion of payment for the ordered products, Spazio Lebole S.r.l. undertakes to ship the ordered products to the customer, under its own responsibility, to the shipping address within 3/5 business days.
All products ordered on the www.lebolemaison.it website are intended for the personal use of the customers or the recipients indicated in the shipping address, who are expressly prohibited from partially or totally reselling the products.
Spazio Lebole S.r.l. will send the Customer a confirmation email once the products have been shipped with the relative tracking code to follow the delivery status.
Shipping will be carried out and monitored by GLS or BRT couriers for Italy and DHL or Poste Italiane for abroad. Any shipping delays attributable to the carrier or to www.lebolemaison.it do not give the customer the right to withdraw from the contract or to request damages or interest. Ordered products are transported at the recipient's risk and peril. In the event that one or more ordered products are missing or damaged, the customer or recipient must file any necessary claims with the carrier at the time of delivery.
In case of an apparent defect, the customer benefits from the right of withdrawal under the conditions provided for by current legislation. Cases of force majeure, and therefore such as to relieve www.lebolemaison.it from its shipping obligations, include war, invasion, fire, strikes, accidents, and inability to be supplied. Due to the availability of ordered products, an order may consist of multiple shipments to the Customer. In the event that the Customer wishes products to be shipped to different addresses, they must place multiple orders, one for each shipping address.
Return PolicyThe Customer always has the right to withdraw from their order within 14 calendar days without having to provide any reason. The withdrawal period begins on the day of order delivery. The order can be returned within the indicated period using a courier of the Customer's choice or by using the free return service offered by Spazio Lebole S.r.l. (valid only within Italian territory).
If the Customer is registered, they can proceed with the return by logging into their account in the “My Orders” section and clicking on “Return Items”.
If the Customer placed an order as a Guest, they can activate the return request by clicking on the “Request a Return” item at the bottom of the site. Fill out the form by entering their email and order number; choose the items to return and the quantity, check the “Return this Item” box, indicate the reason for the return from the drop-down menu, and finally confirm the return.
In both cases, the customer must print the return form and the prepaid label, place the products in their original packaging, and return them to a BRT point.

Once the Customer's package has been received and only after assessing the integrity of the goods, the return acceptance and subsequent refund procedure will be initiated (excluding initial shipping costs where applicable).
The return must concern new items in their original packaging, accompanied by all their accessories. Items returned incomplete, deteriorated, damaged, or soiled will not be accepted. In case of abnormal or abusive returns, Spazio Lebole S.r.l. reserves the right to refuse the return and bears the cost of sending the jewel(s) back to the Customer.

If the Customer has received a flawed, incorrect, or missing product, they are requested to send an email to contatti@lebolemaison.it to report the anomaly. Customer Service will immediately take charge of the request to resolve the problem. Shipping costs for the return or replacement in this case are always borne by Spazio Lebole S.r.l.

It is not possible to return an item purchased on the www.lebolemaison.it website to a Lebole Maison store or retailer. The Customer must return all jewels purchased from the e-commerce site back to it, following the return policy described above. Likewise, it is not possible to return items purchased in stores or at Lebole Maison retailers through the e-commerce site.
It is not possible to return a personalized item, a gadget, or a promotional jewel if it was linked to an order at the time of purchase. When the user purchases this type of item and intends to return one or more products of their order for a refund, it is necessary to return the entire order; therefore, it will not be possible to partially withdraw from the order to return only some of the products included in it.

Exchange

Without prejudice to the Customer's right of withdrawal as described above, additionally, if the user wishes to exchange an item(s), they have 14 calendar days from receipt thereof to replace the item(s) purchased on the www.lebolemaison.it site. Replacement is granted only for a change of color or size of the same item. Exchanges between different items are not granted.

RefundThe refund will be credited to the Customer within 14 business days of receipt of the return. The refund will be made through the payment method used at the time of purchase. If the Customer paid by Bank Transfer or Cash, they must provide an IBAN through which the refund can be issued.

Protection of personal data

All Personal data provided by the Customer will be processed in full compliance with privacy legislation.
In particular, Spazio Lebole S.r.l. - with registered office at Via Margaritone no. 27 A/B/C, 52100 AREZZO - owner of the www.lebolemaison.it website, declares that it uses the personal data voluntarily provided by the Customer in accordance with Legislative Decree no. 196 of June 30, 2003 ("Personal Data Protection Code"), which provides for the protection of individuals and other subjects with regard to the processing of personal data.
According to the indicated legislation, such processing will be based on the principles of correctness, lawfulness, transparency, and protection of the Customer's privacy and rights. To this end, Spazio Lebole S.r.l. undertakes not to distribute online or sell to third parties personal data, except for any legal obligations and technical requirements related to the provision and management of the e-commerce service.
The data controller is the legal representative of Spazio Lebole S.r.l., Barbara Melani Lebole.
Processing will be carried out with the aid of computer tools by Spazio Lebole S.r.l. and its appointed operators, and is aimed at the provision of requested services, the sale of goods, the processing of statistics on the use of the services themselves, and - where specifically authorized - the sending of promotional information, in both digital and paper format (if paper is provided).
The provision of data by the Customer is mandatory in order to carry out the commercial activity, and any refusal to provide such data will result in the non-execution of the sales contract.
At any time, the Customer may request free verification, cancellation, or modification of their data, or receive the list of those in charge of processing, by writing an email to contatti@lebolemaison.it or by sending a written communication to Spazio Lebole S.r.l., Via Margaritone no. 27 A/B/C, 52100 AREZZO.
In addition to complying with all obligations set forth by Legislative Decree 196/2003, Spazio Lebole S.r.l. also guarantees the utmost attention to data protection from fraudulent access and immediate deletion from its lists following a request to that effect by the Customer, who may at any time exercise their rights against the data controller pursuant to Art. 7 of Legislative Decree 196/2003, reproduced here in full:

1. The interested party has the right to obtain confirmation as to whether or not personal data concerning them exists, even if not yet recorded, and its communication in an intelligible form.

c) the logic applied in case of processing carried out with the aid of electronic tools;
d) the identification details of the controller, processors, and the representative designated pursuant to Article 5, paragraph 2;
e) the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of it as designated representative in the State territory, processors, or appointees.
3. The interested party has the right to obtain:
a) updating, rectification, or, when interested, integration of the data;
b) cancellation, transformation into anonymous form, or blocking of data processed in violation of the law, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed;
c) certification that the operations referred to in letters a) and b) have been made known, also as regards their content, to those to whom the data were communicated or disseminated, except in the case where such fulfillment proves impossible or involves a use of means clearly disproportionate to the protected right.
4. The interested party has the right to object, in whole or in part:
a) for legitimate reasons, to the processing of personal data concerning them, even if relevant to the purpose of collection;
b) to the processing of personal data concerning them for the purposes of sending advertising material or direct sales or for carrying out market research or commercial communication.

All elements of the site, texts, works, illustrations, photos, and images reproduced are part of copyright and intellectual property worldwide. They are the exclusive property of Spazio Lebole S.r.l.
Tax DocumentationFor every purchase, Spazio Lebole S.r.l. issues a regular invoice specifying the items, quantity, prices, transport costs, and VAT.
